Terms of Service

1. Acceptance

By creating an account or using MetricHost ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding contract between you and Atlas Studio, Illinois, United States.

2. Eligibility

You must be at least 16 years old if you are in the European Economic Area (EEA), or at least 13 years old elsewhere, to use the Service. By accepting these Terms you confirm you meet the age requirement for your jurisdiction.

3. Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@metrichost.net if you suspect unauthorised access.

4. Prohibited use

You may not use the Service to:

• Host or distribute pirated software, cracked games, or other copyright-infringing content
• Circumvent or remove digital rights management (DRM) protections
• Conduct denial-of-service attacks, exploit vulnerabilities, or otherwise abuse shared infrastructure
• Violate any applicable law or regulation, including export control laws
• Impersonate any person or entity, or misrepresent your affiliation

We reserve the right to immediately suspend accounts found in violation.

5. Subscriptions and billing

Paid plans are billed monthly and renew automatically at the start of each new billing period. If you cancel, your subscription is set to cancel_at_period_end — you retain access until the end of the current paid period, after which your account downgrades to the free tier. No partial refunds are issued for the remaining period.

6. Pricing changes

We may change prices with at least 30 days' notice sent to your registered email address. Any change takes effect at your next renewal after the notice period. Your current billing period is always honoured at the price you paid.

7. EU right of withdrawal

If you are a consumer in the European Union, you have a statutory 14-day right of withdrawal from the date of subscription. However, by clicking "Subscribe" and immediately accessing the Service (provisioning servers), you expressly request that we begin performance before the withdrawal period expires. You acknowledge that once you have provisioned a server your right of withdrawal is thereby forfeited in respect of the digital service already performed, in accordance with Directive 2011/83/EU Art. 16(m).

This does not affect your rights under the Refund Policy for circumstances where the Service has not been used.

8. Service level

We operate on a best-effort basis for free-tier accounts. Paid-tier service level commitments are described in our Service Level Agreement. Scheduled maintenance windows are announced at least 24 hours in advance where practicable.

9. Limitation of liability

To the fullest extent permitted by law, our aggregate liability to you for any claim arising from use of the Service is limited to the total fees you paid us in the 12 months preceding the event giving rise to the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data.

10. Governing law

These Terms are governed by the laws of Illinois, United States, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Illinois, United States, except where mandatory consumer protection law provides otherwise.

11. Termination

For cause: We may terminate your account immediately if you breach these Terms, without prior notice.

For convenience: Either party may terminate the relationship with 60 days' written notice. We will provide a pro-rated refund for any unused prepaid period upon termination for our convenience.

12. Changes to these Terms

We will notify you by email of any material changes at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
